| 1.2 | You/Your/User/Customer means any person using the GrantsOfCornwall.com website or any customer using the services of Grants of Cornwall. |
| 2.0 | Requirements for Use |
| 2.1 | You must be at least eighteen (18) years old to transact with Grants of Cornwall. |
| 2.2 | You must be the legal owner of the property you intend to sell and if requested you will be able to prove that ownership with a receipt or similar documentary proof. |
| 2.3 | You must be acting for yourself as owner of the property to be sold, or, the owner of the property must authorize you in writing to act on their behalf. |
| 2.4 | You must be a resident of the United Kingdom and may be asked to provide documentary proof of such residency |
| 3.0 | Sending your goods to us: |
| 3.1 | You should send your goods to us by Royal Mail Special Delivery, choosing a level of insurance that is adequate for the value of goods sent. |
| 3.2 | On receipt your parcel will be opened in a video recorded secure location and the contents verified and recorded |
| 4.0 | Testing your goods: |
| 4.1 | We will test your gold using high quality industry standard weighing and testing machines and will report the findings back to you as soon as possible, usually within 24 hours of receipt. |
| 4.2 | Part of the testing process for gold can involve the use of chemicals which may discolour your item. This discolouration will not affect the value of your item and should you wish to have it returned, and should be able to be polished out by a jeweler. |
| 5.0 | Non Hallmarked Items |
| 5.1 | We will accept non hallmarked items, however these may require further more detailed testing than hallmarked goods. In this event we will keep you informed of the process and give you a revised timescale for your offer of purchase. |
| 6.0 | Non Gold Items |
| 6.1 | You should remove any non gold items from your goods, (i.e. gem stones) before sending to us. Should your items contain non gold items, these will need to be removed before an offer to purchase can be made. In these circumstances we will contact you before removing any non gold items. |
| 6.2 | Any non gold items will not be returned to you, unless you specifically request them to be returned. If you wish to have these items returned we will agree a price with you before the items are removed for the cost of returning them to you. |
| 7.0 | Our offer to buy your items |
| 7.1 | Once we have received the report on your items we will contact you and explain the findings of the report. |
| 7.2 | Our quoted gold price is subject to administration and refining costs. |
| 7.3 | Our offer to purchase will be based solely on the gold content and weight of your items. |
| 7.4 | The price offered to purchase your gold will be valid for 24 hours, after that time we may need to change the price we can offer you due to fluctuations in the market price for gold. Our valuation will be based on the London Gold Fix price at the time we receive your items. |
| 7.5 | If you accept our offer price for your goods we will also refund your postage costs for sending the items to us. In the unlikely event of you not accepting our quotation, we will return the gold items to you. If you decide NOT to accept the offer, your items will be returned to you by special delivery. Please note that we reserve the right to charge for postage and packaging when returning items. |
| 7.6 | Once the agreed amount of payment for your goods is sent to you, ownership of the goods will pass to Grants of Cornwall |
| 8.0 | Your Payment |
| 8.1 | Once you have accepted our offer we will process your payment within 24 hours excluding weekends and bank holidays. |
| 8.2 | Payments can be made to you by bank transfer or cheque. |
| 8.3 | Bank transfers will be sent within 24hrs, the time to reach you account will depend on your banks current policy (usually no more than 3 days after the payment is sent). |
| 8.4 | Cheques will be sent by royal Mail 1st class post. |
| 8.5 | As soon as we have processed your payment we will assume ownership of the goods and they will be sent for reclamation. |
| 9.0 | Complaints Procedure |
| 9.1 | We aim to offer a level of service that will not draw complaints, however should you not be happy with the service you have received please contact us as soon as possible. We will endeavor to resolve all complaints within 5 working days of receipt. |
| 10.0 | Data Protection |
| 10.1 | Your personal information and payment details will be protected in accordance with the Data Protection Act 1998. |
| 10.2 | You have the right to request a copy of any information held by us, and we reserve the right to charge an administration fee of no more than ?10 for this procedure. Any requests must be in writing to the address above, and signed by you. |
| 10.3 | On receipt of a request in writing we will amend or delete any information held about you that we are not require by law to keep. |
| 10.4 | We are required to keep some information regarding customers for 6 years in order to comply with government regulations. |
| 11.0 | Limitation of Liability |
| 11.1 | This limitation of liability shall be binding on each and every customer and any third party, including, but not limited to, the customer and the customer's successors, assigns, insurance carriers and any other individual or entity asserting any right or claim relating to customer's transaction with Grants of Cornwall. |
| 11.2 | No liability will be accepted for loss or damage resulting from the use of services offered by Grants of Cornwall and in no event shall the company be liable to any third party. |
| 11.3 | Grants of Cornwall shall not be liable for any subrogation claim brought by any customer?s insurer. By sending an item to Grants of Cornwall, the customer expressly and specifically waives any such subrogation claim on his or her behalf as well as on the behalf of his or her insurance company. |
| 12.0 | Indemnification |
| 12.1 | You agree to indemnify, us and our affiliated companies, from any and all claims or demands, made by any third party due to or arising out of your use of the services. |
| 13.0 | Miscellaneous |
| 13.1 | By using the service and therefore accepting the terms and conditions stated above you agree that these Terms and Conditions shall be governed and interpreted in accordance with the law of England and Wales and that any potential dispute will be subject to the jurisdiction of the Courts of England and Wales. |
| 13.2 | We reserve the right to update these terms and conditions from time to time without notice provided. It is entirely your responsibility to check these before using the service offered by Grants of Cornwall. |
| 13.3 | In the event that any of the terms and conditions stated herein is considered to be invalid by a court, this shall not affect the remainder part of these terms and conditions. |
